General Terms and Conditions of Sale
Prices
Our prices are per unit (unless otherwise stated), excluding VAT, in euros, ex works, with shipping and packaging costs charged in addition.
We reserve the right to modify, during the year and without prior notice, the prices of items listed in our catalog, depending on changes in supplier pricing or currency fluctuations.
Our pricing is not intended for end users; our customers are installers and service technicians in the food industry equipment sector.
No minimum order and no invoicing fees for mainland France and the EU.
For exports outside the EU, the minimum order is €350 excl. VAT (goods value). Below this amount, a €25 handling fee will be applied.
Transport
Goods are transported at the recipient’s risk. It is therefore the recipient’s responsibility to carry out all necessary formalities to preserve their rights in case of transport damage, including making any necessary reservations upon receipt of the goods. Notes such as “subject to unpacking” have no legal value; the exact nature of the damage must be specified on the delivery note.
Delivery Times
As a general rule, our items are available from stock. Orders placed before 5 PM from Monday to Friday are shipped the same day. In the event of a stock shortage, we will immediately inform you of the delivery time.
This timeframe is given for information purposes only, and delivery delays cannot justify order cancellation or give rise to compensation.
Backorder Management
In case of stock shortage, missing items are kept on backorder. They will be automatically included in a future order to avoid additional shipping costs. If you wish the backorder to be shipped separately, shipping costs will be charged to you. If you do not wish to maintain the backorder, it can be canceled upon simple request.
Payments
All shipments are payable immediately and without discount, regardless of the amount due. However, from an annual turnover of €3,000 excl. VAT and after our written confirmation, deferred payment by direct debit may be set up. These conditions may be withdrawn at any time in the event of decreased turnover, late payments, or negative financial information.
In the event of debt collection proceedings or legal action, a fixed penalty equal to 15% of the outstanding amounts, with a minimum of €150 excl. VAT, will be due.
Retention of Title
The delivered goods remain our property until full payment has been received (law no. 80.335 of May 12, 1980).
Returns
No returns will be accepted if shipped freight collect, if more than 10 days have passed since invoicing, or without our prior written agreement. In case of an error on our part, we will cover return shipping costs for the concerned goods only.
A return tracking form is available on the website in your customer account. Please use it.
Warranty
Our products are guaranteed for six months from the invoice date against manufacturing defects. This warranty does not apply in cases of improper use (incorrect installation, abnormal use, modification, etc.). In case of warranty claim, the product must be returned to us prepaid with the purchase invoice. The defective item will be sent to the supplier, who will repair or replace it. Repair times vary depending on the supplier.
Technical Specifications
These are provided for information purposes only. Our suppliers reserve the right to modify or discontinue certain products without prior notice. Our products correspond to original parts or are adaptable to machines. We disclaim all responsibility for damage resulting from improper use or adaptation of our parts to unsuitable equipment.
Jurisdiction
All invoices are payable in BAILLEUL. In case of dispute, the Commercial Court of Hazebrouck shall have exclusive jurisdiction.
Product Origin
Since 1984, PANICOUPE has developed expertise in spare parts, components, and consumables for various types of equipment, particularly in the food industry. These products may correspond to original parts in the case of component brands (OMRON, CROUZET, ELIWELL, etc.), or may come from our own manufacturing or subcontractors.
Since then, PANICOUPE has been developing, manufacturing directly or indirectly, and marketing its own products, applying strict professional quality and control standards. These products are adaptable to various machines and industrial installations, whose names—protected where applicable—are mentioned in this catalog solely for reference purposes to indicate product compatibility.
